1. Acceptance of Terms

By accessing or using QikSend ("the Service") at qiksend.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of Service

QikSend is an AI-powered email generation and sending platform that allows users to create HTML emails from text prompts and send them directly from their connected Gmail or Microsoft Outlook accounts. QikSend acts as a tool to facilitate email creation and delivery — it does not operate as an email service provider and does not send emails from its own mail servers.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Connected Email Accounts

When you connect a Gmail or Microsoft/Outlook account to QikSend, you authorize QikSend to send emails on your behalf using that account. You acknowledge and agree that:

• Emails sent through QikSend will appear to recipients as coming from your email address.
• You are solely responsible for the content of emails sent through the Service.
• You will not use the Service to send spam, unsolicited bulk email, phishing emails, or any email that violates applicable laws.
• You will comply with the terms of service of Google (Gmail) and Microsoft (Outlook) when using their services through QikSend.
• QikSend stores your OAuth tokens in encrypted form and uses them only to send emails you explicitly initiate.
• You may disconnect your email account at any time, which will immediately delete your stored tokens.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited commercial email, or bulk email without recipient consent.
• Send emails that are fraudulent, deceptive, misleading, or impersonate another person or entity.
• Distribute malware, viruses, or any harmful code.
• Violate any applicable law or regulation, including CAN-SPAM, GDPR, CASL, or other anti-spam laws.
• Harass, threaten, or harm any individual.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use automated means to access the Service in a manner that exceeds reasonable usage.

We reserve the right to suspend or terminate accounts that violate these acceptable use policies, without prior notice.

6. AI-Generated Content

The Service uses artificial intelligence to generate email content based on your prompts. You acknowledge that AI-generated content may not always be accurate, appropriate, or suitable for your intended purpose. You are solely responsible for reviewing, editing, and approving all AI-generated content before sending. QikSend makes no warranties regarding the accuracy, quality, or fitness for purpose of AI-generated content.

7. Intellectual Property

Our IP: The Service, including its software, design, trademarks, and content (excluding user-generated content), is owned by QikSend and protected by intellectual property laws.

Your content: You retain ownership of the prompts you enter and the emails you generate. By using the Service, you grant QikSend a limited, non-exclusive license to process your content solely to provide the Service.

8. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that emails sent through the Service will be delivered or that delivery will not be delayed.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QIKSEND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF QIKSEND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO QIKSEND IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless QikSend and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by contacting us at [email protected]. Sections 7, 9, 10, and 11 survive termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
